Nancy Kaplan, a Partner in the Environmental Group of Massachusetts member firm Keegan Werlin LLP, presided for 5 months as Hearing Officer in one of the largest potential landfill expansion site assignments in Massachusetts. The hearings focused on the potential reallocation of both Municipal Solid Waste and Construction & Debris materials, as well as the acceptance of solid waste materials, regardless of geographic origin. Approximately 33 parties were involved in the proceeding. Lindsey H. Taylor of New Jersey member firm Carella, Byrne, Bain, Gilfillan, Cecchi, Stewart & Olstein recently argued an appeal before the U.S. Court of Appeals for the Second Circuit relating to whether a Southern District of New York bankruptcy trustee’s professional malpractice complaint should have been dismissed because the trustee failed to comply with New Jersey’s statute requiring service of an affidavit of merit in professional malpractice cases applying New Jersey law. The firm, through Taylor and James E. Cecchi, argued in the Bankruptcy Court that the trustee’s complaint should be dismissed. The Bankruptcy Court ruled that the complaint should not be dismissed, but the District Court found that the affidavit of merit statute applied and dismissed the trustee’s complaint. The Second Circuit affirmed the decision of the District Court.

The County of Essex (Newark, NJ) honored the Honorable Brendan T. Byrne by naming and dedicating the State Court Plaza in his name. Governor Byrne served as the Prosecutor of and a State Court Judge in Essex County, as well as the President of the Board of Public Utilities before his election to two terms as Governor of New Jersey.
